These Terms and Conditions set out the basis on which we provide waste disposal and rubbish collection services in West Kensington and surrounding areas. By booking any service with us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business or organisation requesting the waste disposal or collection service.
We, us, our means the waste disposal service provider operating in West Kensington.
Services means any waste removal, rubbish collection, junk clearance, recycling or related work we agree to perform.
Waste means any items, materials or rubbish the Customer asks us to remove, subject to the exclusions and regulations described in these Terms and Conditions.
We provide waste disposal and collection services for domestic, commercial and light construction customers, including but not limited to removal of general household rubbish, bulky items, garden waste and certain types of business waste.
The exact scope of the Services to be provided will be agreed at the time of booking, based on the information supplied by the Customer. Our obligations are limited to those Services expressly confirmed in our booking confirmation or written communication.
We reserve the right to decline any job that is unsafe, unlawful, impractical, or outside our permitted waste categories under applicable UK waste regulations.
Bookings for waste collection in West Kensington may be made by telephone, email or through our online enquiry or booking system, where available.
To make a booking, the Customer must provide accurate and complete information, including:
Full name and contact details.
Collection address and, where relevant, any access instructions.
Type, estimated volume and approximate weight of the waste.
Preferred date and time window for collection.
Any special circumstances that may affect the collection, such as restricted parking, limited access, or the presence of heavy or awkward items.
All bookings are subject to availability and are only confirmed when we issue a booking confirmation. We may refuse or cancel a booking where the information supplied is incomplete, inaccurate or where we reasonably believe the job cannot be carried out safely or lawfully.
Any price estimate given before collection is based on the details provided by the Customer. If, on arrival, the waste volume, type or access conditions differ from the information originally supplied, we reserve the right to adjust the price to reflect the actual circumstances.
Our pricing may be based on volume, weight, labour time, access difficulty, parking requirements and disposal charges at licensed facilities. We will notify the Customer of any price variation before starting work. If the Customer does not agree to the revised price, we may cancel the job, and a call-out or cancellation fee may apply, as described in these Terms and Conditions.
All prices are quoted in pounds sterling and may be subject to VAT or other applicable taxes, which will be clearly stated where charged.
Payment for waste disposal services is due in full on completion of the collection, unless otherwise agreed in writing in advance.
We may accept payment by cash, bank transfer, debit card or credit card, subject to the payment methods we make available from time to time. For business accounts and regular commercial customers in West Kensington, we may agree alternative payment terms, such as invoicing with a specified credit period.
Where payment is not received on the due date, we reserve the right to charge interest on the outstanding balance at the statutory rate, together with any reasonable costs of collection or enforcement. Title to any collected waste transfers to us only when payment is received in full, subject to applicable waste regulations.
The Customer is responsible for providing suitable access to the collection location at the agreed time. This includes ensuring that:
There is safe and reasonable access for our team and vehicle.
Any gates, doors or communal areas are unlocked or otherwise made accessible.
Parking arrangements are in place, where needed, and any permits or authorisations are obtained in advance.
Waste is segregated and ready for collection in accordance with our instructions, where applicable.
Where parking fees or fines are incurred because adequate arrangements have not been made by the Customer, we may add these costs to the final invoice. If we cannot carry out the collection due to lack of access or unsafe conditions, a wasted journey fee may be charged.
We operate in accordance with UK waste legislation and local authority requirements relevant to the West Kensington area. Certain materials are hazardous or restricted and cannot be collected without prior arrangement or specialist licensing.
Prohibited or restricted items may include, but are not limited to:
Asbestos and materials containing asbestos.
Chemicals, solvents, oils and paints.
Clinical, medical or biological waste.
Pressurised containers and gas bottles.
Explosives, firearms, ammunition and dangerous substances.
Electrical or electronic equipment requiring specific disposal procedures, unless expressly agreed.
If such items are found within the waste without prior disclosure, we may refuse to remove them, adjust the price, or suspend the job. The Customer is responsible for any legal or regulatory consequences arising from the inclusion of prohibited items that they have supplied.
We will make reasonable efforts to attend at the agreed collection time or within the specified time window. However, all times are estimates and may be affected by traffic conditions, previous jobs, weather or circumstances beyond our control.
If we expect a significant delay, we will endeavour to notify the Customer as soon as reasonably practicable. We are not liable for any loss, costs or inconvenience arising from delays or missed appointments, except where caused by our wilful misconduct or gross negligence.
The Customer may cancel or amend a booking by contacting us directly. The following terms apply:
If the Customer cancels more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged.
If the Customer cancels within 24 hours of the scheduled collection time, we may charge a cancellation fee to cover administrative and scheduling costs.
If we arrive on site and are unable to complete the job due to access issues, incorrect information about the waste, or the absence of an authorised person where required, we may charge a wasted journey fee.
We reserve the right to cancel or reschedule a booking in the event of adverse weather, vehicle breakdown, staff illness, safety concerns or other circumstances outside our reasonable control. In such cases, we will seek to agree a new collection time with the Customer.
The Customer warrants that:
They are the owner of the waste or have the authority of the owner to arrange its removal.
The waste does not contain any prohibited materials or items requiring special handling, unless they have been fully disclosed and agreed in advance.
The information provided about the location, volume and type of waste is accurate and not misleading.
The collection and removal of the waste will not breach any law, lease, licence or third-party rights.
The Customer agrees to indemnify us against any claims, losses, damages or expenses arising from a breach of these warranties.
We will carry out our Services with reasonable care and skill. However, our liability to the Customer is limited as follows:
We are not liable for any indirect, consequential or economic loss, including loss of profits, revenue, business or opportunity, arising out of or in connection with the provision of the Services.
We are not liable for any damage to property where such damage arises from pre-existing defects, structural weaknesses, poor installation, or where the Customer has failed to inform us of relevant risks or fragility.
Our total aggregate liability for any loss or damage arising from a single event or series of connected events shall not exceed the total price paid or payable by the Customer for the relevant Services, except where such limitation is not permitted by law.
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law.
We operate as a licensed waste carrier in accordance with applicable UK regulations and are committed to responsible and legal waste management in West Kensington and beyond.
Once payment is received and the waste is loaded onto our vehicle, title and responsibility for the waste transfers to us, subject to statutory obligations. We will transport the waste to an appropriately licensed facility for recycling, recovery or disposal, in line with our environmental policies and prevailing legislation.
We may issue a waste transfer note, receipt or similar documentation where required. The Customer should retain such documentation for their records and to demonstrate compliance with their own legal obligations, particularly where they are a business or commercial operator.
If the Customer is dissatisfied with any aspect of our Services, they should notify us as soon as possible, providing full details of the issue and any supporting information.
We will investigate complaints in a fair and timely manner and will seek to resolve matters by repair, re-performance, partial refund, full refund or another appropriate remedy, depending on the circumstances and our legal obligations.
Where a dispute cannot be resolved informally, either party may consider mediation or other alternative dispute resolution methods before resorting to court proceedings, although this is not a mandatory requirement.
We will collect and process personal information about the Customer, such as name, contact details and service history, for the purposes of administering bookings, delivering Services, taking payment and handling any queries or complaints.
We will handle personal data in accordance with applicable UK data protection laws. We will not sell personal information to third parties, and we will only share it where necessary to provide the Services, comply with legal obligations, or where the Customer has expressly consented.
We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our business practices or the Services we offer. The latest version will apply to any new booking. We recommend that Customers review these Terms and Conditions periodically.
Any change to the Services or these Terms and Conditions that is agreed individually with a Customer will only be binding if recorded in writing by us.
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, including any non-contractual disputes or claims.
By placing a booking for waste disposal or rubbish collection in West Kensington, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
